A Letter to the Bankruptcy Community

In this letter to the bankruptcy community, the Clerk provides a reminder of the bankruptcy rule and form amendments that take effect on December 1, 2013.  The clerk provides a summary overview of the amendments and link access to the amendments in their entirety.  In addition, the clerk advises of changes to the Bankruptcy Miscellaneous Fee Schedule, also effective December 1, 2013.  A red-lined version outlining the changes is included in this announcement.

Court Continues Normal Operations

The United States Bankruptcy Court for the Northern District of Iowa will continue normal operations in Cedar Rapids and Sioux City for the duration of the current federal government shutdown, absent further notice. All proceedings and deadlines remain in effect as scheduled, unless otherwise advised. CM/ECF (Case Management/Electronic Case Files) will continue to be fully functional. The United States Trustee has indicated that all §341 Meetings of Creditors will be conducted as scheduled unless further notified

Standing Order No. 13-02 Order Amending Local Rule 2002-1

Standing Order No. 13-02, signed May 24, 2013, amends Local Rule 2002-1 to shorten the time for notice of §341 meetings of creditors in the Cedar Rapids Division for chapter 7 cases.

Proposed change to Local Rule 2002-1 affecting the Cedar Rapids Division:

An amendment to the U.S. Bankruptcy Court for the Northern District of Iowa Local Rule 2002-1 shortening the time for notice of §341 meeting in the Cedar Rapids division for chapter 7 cases is being considered. The following amendment is proposed:

“(a) Notice of creditors’ meetings in chapters 12 and 13 [strike the underlined portion]

In cases under chapter 12 or 13, or in chapter 7 cases filed in the Cedar Rapids division, the meeting of creditors under 11 U.S.C. § 341 may be set on 14 days’ notice.” [New language in italics].

New Claims Transfer Fee to Take Effect May 1, 2013

Effective May 1, 2013, the bankruptcy courts will begin charging a new fee of $25 for
each claim transferred. This fee was approved by the Judicial Conference of the United
States at its September 2012 session.

Dollar Amount Adjustments

Automatic adjustments will be made on April 1, 2013, to dollar amounts stated in various provisions of the Bankruptcy Code, one provision in Title 28, seven Official Bankruptcy Forms which contain adjusted dollar amounts, and two Director's Forms which include dollar amounts. The adjustments will apply to cases filed on or after April 1, 2013
