Clerks Entry of Default: Adversary

A motion for default judgment is a two-step process. The plaintiff should first request the clerk to enter the "clerk's entry of default". Then the plaintiff should ask for a default judgment or Motion for Default Judgment.

Motion for Default Judgment

This document is filed by the plaintiff when he wants a judgment awarding the specific relief requested in the complaint. It should be accompanied by an affidavit regarding service which specifies that the defendant is competent and is not currently serving in the military. Seal

Summary Judgment

Any party can seek summary judgment when the party believes there is no issue of fact to be determined and he is entitled to prevail as a matter of law. Withdrawal of Reference

Though all district courts have entered orders referring cases and proceedings under title 11, United States Code, to the bankruptcy judges, the district court never relinquishes its power to hear and resolve these matters itself. The district court may, on the district judge's own motion or upon the motion of a party, withdraw any case or proceeding or any part of any case or proceeding referred to the bankruptcy judges.
