Proposed Amendments to the Federal Rules and Forms Posted for Public Comment through February 16, 2022

The Judicial Conference Committee on Rules of Practice and Procedure has approved publication for public comment of the following proposed amendments to existing rules and forms, as well as several new rules and forms:

  • Appellate Rules 2 and 4
  • Bankruptcy Restyled Rules Parts III-VI; Rules 3002.1, 3011, and 8003; and new Rule 9038
  • Official Bankruptcy Forms 101, 309E1, 309E2, and 417A; and new Official Bankruptcy Forms 410C13-1N, 410C13-1R, 410C13-10C, 410C13-10NC, and 410C13-10R
  • Civil Rules 15, 72, and new Rule 87
  • New Criminal Rule 62
  • Evidence Rules 106, 615, and 702

The proposals include rules for declared emergencies as directed by the Coronavirus Aid, Relief and Economic Security Act (CARES Act), Pub. L. No. 116-136, 134 Stat. 281 (Mar. 27, 2020). The emergency rules are reflected in the proposed amendments to Appellate Rules 2 and 4, and proposed new Bankruptcy Rule 9038, Civil Rule 87, and Criminal Rule 62.

The public comment period opened August 6, 2021 and closes on February 16, 2022.
